TERMS OF USE
These Terms of Use (“Terms”) govern your access to and use of the Piggyback Collective website, platform, forms, submissions, listings and related services (“Platform”).
Piggyback Collective is operated by Troy Reid ABN 52 217 190 116, trading as Piggyback Collective (“Piggyback”, “we”, “us”, or “our”).
By accessing or using the Platform, submitting an enquiry, submitting a reward or receipt, browsing business listings, engaging with participating clubs or businesses, or otherwise interacting with Piggyback, you agree to be bound by these Terms.
If you do not agree to these Terms, you must cease using the Platform immediately.
1. PURPOSE OF THE PLATFORM
Piggyback Collective operates as a promotional, referral and community connection platform that facilitates relationships between local businesses, sporting clubs and members of those communities.
Piggyback may provide:
– business listings;
– club listings;
– member offers;
– promotional content;
– referral coordination;
– receipt or reward submission systems;
– enquiry forms;
– community campaigns; and
– other related services.
Piggyback acts solely as an intermediary promotional platform.
Piggyback is **not**:
– a supplier of goods or services;
– a contractor;
– a recruitment agency;
– a health provider;
– a builder or tradesperson;
– a financial adviser;
– a legal adviser;
– an employment provider;
– an insurer;
– an agent for any participating business or club; or
– a guarantor of outcomes.
All goods and services are provided independently by participating businesses.
2. NO GUARANTEE OF CLUB REWARDS OR BENEFITS
Piggyback may facilitate systems intended to help clubs benefit from member spending.
However, Piggyback does **not guarantee**:
– any club payment;
– any reward;
– any referral attribution;
– any revenue outcome;
– any business participation;
– any offer remaining active;
– any level of member engagement;
– any timing of payments; or
– that a submitted purchase or transaction will qualify for a club benefit.
Receipt submissions, reward claims or transaction notifications are not guaranteed to result in attribution or payment.
Piggyback may, in its sole and reasonable discretion, determine whether a transaction qualifies as attributable to the Platform.
3. BUSINESS LISTINGS & OFFERS
Businesses featured on Piggyback operate independently.
Piggyback does not warrant, endorse, verify or guarantee:
– business quality;
– workmanship;
– pricing;
– business credentials;
– qualifications;
– licensing;
– suitability;
– outcomes;
– availability;
– safety; or
– customer satisfaction.
Business offers, discounts, pricing, promotions and participation may change, be suspended or withdrawn at any time without notice.
Piggyback accepts no liability for any inaccuracies or outdated information appearing on business listings.
Users engage businesses at their own risk.
4. CLUB PARTICIPATION
Participating clubs operate independently of Piggyback.
Piggyback does not guarantee:
– club participation;
– club behaviour;
– how clubs promote businesses;
– how clubs communicate with members;
– club governance;
– club financial arrangements; or
– any benefit to members.
Clubs may join, suspend or withdraw from Piggyback at any time.
5. PROFESSIONAL SERVICES DISCLAIMER
Certain participating businesses may provide professional, skilled or regulated services, including but not limited to:
– trades;
– electrical services;
– roofing;
– building services;
– insulation;
– ventilation;
– health services;
– physiotherapy;
– coaching;
– fitness training;
– recruitment;
– consulting;
– financial services; and
– other specialist advice.
Piggyback does not verify qualifications, credentials, licences, insurance, suitability or competency.
Piggyback does not provide professional advice and is not responsible for any outcomes, injury, loss, damage, dissatisfaction or disputes arising from services provided by participating businesses.
Users must undertake their own enquiries and due diligence.
6. USER RESPONSIBILITY
You acknowledge and agree that you are solely responsible for:
– assessing the suitability of businesses;
– verifying any offer;
– conducting your own due diligence;
– entering into arrangements with businesses;
– payment decisions;
– reviewing contracts or service agreements;
– confirming licences or insurance; and
– protecting your own interests.
You use the Platform entirely at your own risk.
7. RECEIPT, REWARD & SUBMISSION SYSTEMS
Piggyback may allow users to upload:
– receipts;
– invoices;
– screenshots;
– proof of purchase;
– reward submissions;
– enquiry information; or
– other content.
Submission of information does not guarantee:
– referral recognition;
– club attribution;
– club benefit;
– payment;
– reimbursement; or
– acceptance of the submission.
Piggyback may request further information or reject any submission at its sole discretion.
Piggyback is not responsible for lost, incomplete, inaccurate or delayed submissions.
8. PLATFORM CONTROL
Piggyback reserves the right, at its sole discretion and without notice, to:
– add, remove or modify businesses;
– add, remove or modify clubs;
– suspend or remove offers;
– reject enquiries;
– reject reward claims;
– remove content;
– suspend or terminate participation;
– restrict access; and
– modify how the Platform operates.
Piggyback is not required to provide reasons for such decisions.
9. NO PARTNERSHIP, AGENCY OR FIDUCIARY RELATIONSHIP
Nothing in these Terms creates:
– a partnership;
– agency relationship;
– employment relationship;
– fiduciary duty;
– joint venture; or
– representative authority
between Piggyback and any club, business or user.
Businesses and clubs act independently.
Piggyback does not represent either party.
10. THIRD-PARTY WEBSITES & LINKS
The Platform may contain links to third-party websites.
Piggyback has no control over third-party websites and accepts no responsibility for:
– website content;
– accuracy;
– security;
– privacy;
– products;
– services; or
– outcomes.
Accessing third-party websites is at your own risk.
11. WEBSITE AVAILABILITY
Piggyback does not guarantee uninterrupted access to the Platform.
We may suspend, modify or discontinue parts of the Platform at any time.
We are not liable for:
– downtime;
– interruptions;
– technical issues;
– data loss;
– website errors; or
– delays.
12. INTELLECTUAL PROPERTY
All content on the Platform, including branding, logos, wording, graphics, text, layouts and materials, remains the intellectual property of Piggyback unless otherwise stated.
You must not reproduce, distribute, copy, modify or commercially exploit content without written permission.
13. USER SUBMISSIONS
By submitting information to Piggyback, including forms, enquiries, testimonials, reviews, receipts or uploaded content, you grant Piggyback a non-exclusive, royalty-free licence to use, store, reproduce and administer that content for operational, marketing or administrative purposes.
You warrant that submitted information is accurate and lawful.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Piggyback excludes all liability for any loss, claim, injury, damage, cost or expense arising from:
– use of the Platform;
– participation in Piggyback;
– dealings with businesses;
– dealings with clubs;
– reliance on information;
– failed referrals;
– missed rewards;
– delayed rewards;
– business conduct;
– poor workmanship;
– injury;
– professional advice;
– disputes;
– website interruptions; or
– any indirect or consequential loss.
Where liability cannot be excluded, Piggyback’s liability is limited to the minimum amount permitted by law.
15. INDEMNITY
You agree to indemnify and hold harmless Piggyback, Troy Reid, contractors, representatives and affiliates against any claim, demand, liability, damage, legal cost or expense arising from:
– your use of the Platform;
– your dealings with clubs or businesses;
– breach of these Terms;
– inaccurate information you provide; or
– unlawful conduct.
16. PRIVACY
Your use of the Platform is also governed by our Privacy Policy.
By using the Platform, you consent to Piggyback collecting, storing and using information submitted through forms, enquiries and reward systems.
17. CHANGES TO THESE TERMS
Piggyback may amend these Terms at any time without notice.
Continued use of the Platform constitutes acceptance of the updated Terms.
18. GOVERNING LAW
These Terms are governed by the laws of Western Australia.
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
